These terms apply when you use the SOL MICHERAE website and purchase our digital card packs. SOL MICHERAE is operated by Chivonne Bain (“we”, “us”, “our”). By using the site, you agree to these terms.

Who you are contracting with

Your contract is with Chivonne Bain, trading as SOL MICHERAE, Luxury Digital Cards & Stationery. References to “SOL MICHERAE” or “the service” mean this website and the digital cards and related features we provide through it.

Using the service

You may use the service to purchase card packs, personalise digital cards, download them and share them via unique links. You confirm that you are of legal age to form a binding contract, or that you have authority to bind the organisation you act for. You are responsible for keeping your sign-in details confidential and for all activity under your account. Please tell us promptly if you believe your account has been compromised.

Your cards and content

You keep the rights to the words and names you enter into a card (“your content”). You grant us a limited licence to store and process your content solely to provide the service — for example, displaying it on the card, in downloads and on the recipient page for its share link. You confirm that your content does not infringe anyone else's rights and complies with the acceptable-use rules below. You are responsible for how you use the cards you create and for verifying that what you write is accurate and appropriate.

Acceptable use

You must not misuse the service. In particular, you must not:

  • use it for any unlawful purpose, or to send unlawful, hateful, harassing or defamatory content;
  • engage in fraud, spam, or attempts to deceive recipients;
  • infringe our intellectual property or anyone else's;
  • interfere with the security of the service — including introducing malware, probing or scanning for vulnerabilities, scraping the site, or attempting to obtain cards or content without paying.

Our intellectual property

The service, including its software, card designs, artwork, branding, documentation and website, is owned by Chivonne Bain and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service within the card pack you purchased, for personal, non-commercial purposes. You may not reverse engineer the service, resell or redistribute it, or circumvent its limits.

Purchases, payment and taxes

Card packs are one-time purchases; there is no subscription and nothing renews automatically. Purchased cards are added to your account after payment is confirmed, and each completed card uses one credit from your balance. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Service availability

We work hard to keep the service available and accurate, but we do not guarantee that it will be uninterrupted, error-free, or that every feature will always work on every device. The service is provided “as is”, and all implied warranties (including merchantability and fitness for a particular purpose) are disclaimed to the fullest extent permitted by law.

Suspension and termination

We may suspend or end your access to the service if you materially breach these terms, fail to pay for a purchase, create a security or fraud risk, or seriously or repeatedly violate any of our policies. Where lawful and practical, we will tell you before doing so. If your access ends, you will lose access to your account and any unused card credits, except where we are legally required to keep records.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages — including lost profits, lost data or lost goodwill. Our total liability to you for any claim is capped at the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.

Indemnity

You agree to compensate us for claims arising from your content, your unlawful use of the service, or your breach of these terms.

Changes to these terms

We may update these terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, notify you in the service. Continued use of the service after changes take effect means you accept the updated terms.

Governing law and disputes

These terms are governed by the laws of The Commonwealth of The Bahamas, without regard to conflict-of-law rules. The courts of The Bahamas have exclusive authority over any dispute, except where local consumer law gives you the right to bring a claim elsewhere.

Other terms

You may not transfer your rights under these terms to someone else without our consent; we may assign them in connection with a merger or acquisition. If any part of these terms is found unenforceable, the rest stays in force. We are not liable for delays caused by events beyond our reasonable control.
